Hemp Licensing Changes for 2026

Minnesota has set April 30 as the final date for growers and processors to apply for industrial hemp licenses for the 2026 season. A license from the Minnesota Department of Agriculture (MDA) is required for anyone planning to grow or process industrial hemp during the year. Each license remains valid until December 31 and must be renewed annually to continue participation in the program.

So far, about 30 applications have been submitted for 2026, which is lower compared to 84 applicants last year. This decline shows a change in interest or awareness among producers. It is important to note that these licenses are strictly for industrial hemp. They do not allow the growth, sale, or processing of adult-use or medical cannabis. New rules have been introduced for the 2026 season. The extraction of cannabinoids from hemp is now regulated separately by the Office of Cannabis Management. Anyone interested in cannabinoid processing must obtain a license from that authority.

License fees have also changed. The minimum cost is now $400, and each additional growing or processing location costs $250. A 5 percent surcharge has been added to improve online systems and processing efficiency. All applicants and authorized representatives must pass a criminal background check before approval.

Testing requirements remain strict. Each hemp crop lot must undergo pre-harvest THC testing to ensure compliance with legal limits. The cost for each official sample collected is $100.
